1. General Terms

1.1. This Agreement serves as a public offer by the private entrepreneur Olga Budnik (Osoba samostatně výdělečně činná Olga Budnik, IČO 09433139, DIČ CZ8458111288, Menclova 2494/2b, Praha 18 000, Czech Republic), representing The Posture Kids Program (hereafter referred to as the “Provider”), to establish a contract under the terms outlined below with any individual (hereafter the “Customer”). This document qualifies as a public offer in accordance with Section 1731 of the Czech Civil Code (Act No. 89/2012 Coll.).

1.2. By accepting this public offer, the Customer gains all rights and responsibilities associated with being a Customer, as defined in this Agreement.

1.3. The Customer accepts this offer by making a partial or full payment for informational and educational services as outlined in this Agreement. Once funds are received by the Provider, the Agreement is officially binding between the Provider and the Customer.

1.4. By accepting this Offer, the Customer acknowledges that they have thoroughly reviewed the Agreement terms, as well as the rules and specific features of the payment system and the website hosting the training materials. The Customer confirms these are fully suitable for achieving the purposes of this Agreement.

1.5. Acceptance of this offer also confirms that the Customer agrees to receive the Provider’s services remotely using software (hereafter “Software”) and that they have the necessary access and technical capability to utilise such services.

1.7. Terms and Definitions

Agreement This document, published online or sent for review by email or other electronic means.

Course / Program The Posture Kids Program — an educational service that includes video routines, instructional materials, home environment guides, and access to supporting resources in video, PDF, audio, or text formats. The content may be updated or expanded over time. Referred to as “Course” or “Service” in this document.

Software Any internet browser or application required to access online resources. The Customer is responsible for ensuring they have the required Software.

Platform The remote learning system hosted on Thinkific, located at https://posturekidsclub.thinkific.com, which provides the Customer with access to Course materials.

Website The online resource with complete information about the Course content and pricing plans, hosted at https://theposturekidsclub.com.

Pricing Plan A specific package of services selected by the Customer, as described on the Website.

2. Subject of the Agreement

2.1. This Agreement involves the provision of paid access to the materials of The Posture Kids Program to the Customer.

2.2. The Customer pays for the Service, and the Provider agrees to deliver it according to the Pricing Plan selected by the Customer.

2.3. Topics, programmes, service costs, and registration are provided on the Website.

2.4. Services are rendered remotely via the internet using Software unless stated otherwise on the Website.

2.5. The Service includes providing the Customer with access to Course materials on the Platform.

3. Provision of Services

3.1. The Provider delivers the Service according to the Pricing Plan selected by the Customer.

3.2. After the Customer completes payment, they receive access to the Platform where training materials are posted. The duration of access depends on the Pricing Plan selected:

3.3. Fulfilment of the Service is considered complete upon providing access to the Course materials.

3.4. If the Customer does not access the materials, the Provider’s obligations are still considered fully met.

3.5. The exercises and routines included in the Course are designed for general educational purposes. The Provider is not a licensed medical provider. It is recommended that the Customer consult a qualified medical professional before beginning any new exercise programme, particularly if the child has a diagnosed medical condition.

3.6. The Customer is responsible for monitoring updates and communications from the Provider under this Agreement.

4. Payment and Refund Policy

4.1. The Service cost is published on the Provider’s Website and may change at any time. Updated prices do not affect services already paid for.

4.2. The Customer pays for the Service via credit card using Stripe on the Website.

4.3. Payment is required in full before accessing the Course, except where an instalment plan is offered.

4.4. Payment is considered complete when funds are credited to the Provider’s Stripe account.

4.5. Membership Pause: Customers on a 3-Month or 12-Month Plan may request a pause of their access for reasons such as illness or travel. Pauses are available up to 5 times per membership period for a combined total of no more than 30 days. Pause requests must be submitted to the Provider in writing with the requested start and end dates. Lifetime Access holders do not require a pause, as their access is permanent.

4.6. Refunds are available within 14 days of payment, provided the Customer has not accessed paid content on the Platform. Services are considered satisfactory unless the Customer submits a written quality complaint within 14 days. The Provider will review claims within three business days and may refund or deny the request based on the review.

4.7. The Provider may withhold a portion of the refund for costs incurred up to the time of the request.

4.8. Unused materials are still considered part of the Provider’s costs.

4.9. Refunds are processed within 14 business days.

4.10. A refund results in the immediate termination of the Customer’s access to all Course materials.

6.1. Both parties are liable in accordance with the law of the Czech Republic.

6.2. The Provider is not liable for service disruptions due to the Customer’s technical issues, internet connectivity, or third-party platform outages.

6.3. Information and exercises provided by the Provider are educational in nature and do not guarantee specific health, developmental, or postural outcomes for any individual child.

6.4. The Provider is not liable for any injury or adverse outcome resulting from the Customer’s failure to follow safety guidance or to consult a qualified medical professional as recommended.

7. Personal Data and Privacy

7.1. The Customer agrees to the processing of their personal data solely for the purposes of this Agreement and the delivery of the Course, in accordance with the Provider’s Privacy Policy available at https://theposturekidsclub.com/privacy_policy.

7.2. The Customer may withdraw consent to data processing by notifying the Provider in writing. Withdrawal of consent may result in termination of access to the Platform and deletion of the Customer’s account.

7.3. The Provider processes personal data in compliance with the General Data Protection Regulation (GDPR) and, where applicable, the UK GDPR.

8. Intellectual Property

8.1. All Course materials, including but not limited to video content, written guides, illustrations, and programme structure, are protected intellectual property owned by the Provider.

8.2. No rights to any content are transferred to the Customer. The Customer is granted a personal, non-transferable, non-exclusive licence to access and use the Course materials for personal, non-commercial purposes only.

8.3. Any reproduction, distribution, republication, or public display of Course materials without prior written consent from the Provider is strictly prohibited.

9. Final Provisions

9.1. This Agreement is effective upon acceptance (payment) and remains in force until all obligations are fulfilled or access expires, whichever occurs later.

9.2. Disputes will be resolved first by negotiation between the parties. If no resolution is reached, disputes will be submitted to the competent court in accordance with the law of the Czech Republic.

9.3. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior communications and agreements.
